Terms of Service

By using Digitalku's services, you are deemed to have read, understood, and agreed to all the terms stated below. Please read these terms carefully before using our services.
A. Obligations
- Digitalku is obligated to provide services according to the package selected by the customer.
- Customers are obligated to comply with all applicable Terms of Service.
- Digitalku reserves the right to amend these terms at any time with prior notice to customers.
B. Fees & Payment
- Payment is made via bank transfer to the account listed on the invoice.
- Payment confirmation must be submitted within 24 hours of transfer.
- Account access will not be activated until payment is received and confirmed.
- If a hosting invoice remains unpaid for 20 days past the due date, all data and the account will be permanently deleted.
- Overpayments exceeding Rp 1,000 will be credited to the customer's account deposit balance.
- Deposit balances unused for more than 1 (one) year will expire automatically.
C. Guarantees & Refunds
- Digitalku offers a money-back guarantee in accordance with the policy applicable to each service. See full details on the Money-Back Guarantee page.
- Server uptime guarantees apply according to the SLA stated in the service package. See details on the Uptime Guarantee page.
- VPS Forex customers are subject to specific terms explained on the VPS Forex Commitment & Guarantee page.
- Refunds cannot be issued if service termination results from the customer's violation of these Terms of Service.
D. Limitations of Liability
- Customers are solely responsible for the accuracy of data entered into the system.
- Customers are responsible for website security, including regular updates to CMS, themes, and plugins.
- Customers are responsible for keeping their account username and password confidential.
- Backups provided by Digitalku are supportive in nature and are not a substitute for the customer's own independent backups. Customers are advised to perform regular backups and store them in a separate location.
E. Acceptable Use Policy
Customers are prohibited from using Digitalku's services for:
- Distributing or storing unlawful content, including pornography, gambling, and content inciting hatred or discrimination.
- Attacking other systems or networks (hacking, spamming, phishing, DDoS, etc.).
- Using server resources excessively in a way that disrupts performance for other users (intensive CPU/RAM usage).
- Distributing malicious software (malware, viruses, ransomware, etc.).
- Any activities that violate applicable laws in the Republic of Indonesia.
F. Services Provided
- Shared Hosting: database capacity up to 5 GB and email up to 15 GB depending on the selected package.
- VPS: Digitalku provides unmanaged VPS. Server configuration and maintenance are the sole responsibility of the customer.
- Indonesian Domains (such as .id, .co.id, .sch.id, etc.) require supporting documents per PANDI regulations. Failure to provide documents may prevent the domain from being activated.
G. Additional Terms
- Domain registration and renewal fees are non-refundable once the domain is activated, as fees have been paid to the registry.
- Domain renewal is recommended at least 30 days before the expiry date to avoid expiration or the domain being claimed by another party.
- Digitalku resellers are fully responsible for technical support to their end customers, as well as for content hosted by their customers.
- Data migration from an old cPanel to Digitalku's server is available free of charge, subject to applicable terms and conditions.
H. Violations & Penalties
- Violations of these Terms of Service may result in service deactivation or termination without refund.
- Hacking, defamation, or misuse of services may be subject to legal action under applicable Indonesian law.
- Digitalku reserves the right to take immediate action without notice if there is an indication of a threat to network security or a serious violation.
